Department medical assesment

I have ADHD and receive esa and pip I was not due a medical for another year however in 2016 I was refused pip mobility criteria I can't use public transport as it causes me psychological distress anyway after this court ruling by the High Court the other week I've already had a medical assessment which was today do you think this is the reason as I was in the criteria of what the High Court said I was discriminated against cause department said psychological wasn't enough but now the courts over turned this getting daily living allowance and not the mobility and also is ESA and Pip medical all just one combined medical assessment now please help many thanks ?

    Hi,

    No, it wouldn't have been because of the recent Upper Tribunal ruling. All reviews for PIP are done 1 year before the award ends, so the review you just had was correct.

    The PIP descriptors for psychological distress have not change yet, i've heard they will in due course but haven't as of yet.

    No ESA and PIP are totally different benefits are the assessment aren't combined.

      Thanks so much for you reply much appreciated Denise great lady: ) yes I took specialist letter and tablets to them I was just thinking as I do the criteria the high court have died on as I was denied in 2016 higher rate regarding traveling in public I lost vital points I can't travel on them .

      You're very welcome Jadon. Thank you also. As you were awarded those points in 2016 that new Upper Tribunal ruling doesn't apply to you, unfortunately. DWP changed the descriptors for following an planning a journey in April 2017, they added "for reasons other than psychological distress". Those that have been award after this was added will be reviewed at some point in the future but this could take a very long time. DWP did announce that they will contact claimants in due course. 

      Fingers crossed you'll be awarded it this time and you sent in evidence to prove it. Good luck.

      Yes, it's very complicated. As your last award was in 2016 this was before DWP added psychological distress to the following and planning a journey descriptors, because it wasn't changed until April 2017. All those awarded after that date will be reviewed at some point. As you've now had another assessment then that's correct. Hopefully for you, you'll be awarded those points.

      I don't know how true this is but as far as i know DWP have not as yet changed ANY of the PIP descriptors for mental health. They are still referring to the old descriptors where psychological distress is NOT taken into account by decision makers as yet. They will at some point in the future be changed and when they are changed they will review all those affected. My advice to you is to be prepared to be refused Enhanced mobility for following and planning a journey. I wish you good luck and will keep my fingers crossed for you.
