DLA for my son

Hi just to let use guys no I appeal my sons DLA cause he walks on his tip toes any way to cut a long story short I won his appeal at tribunal I didn't attend as I have recently HD to strokes I wrote a letter e plaimg to the judge and he did it on a paper tri unaial after 13 months of waiting finally got it what a relief and would just like to thank every body for all there advise it helped a lot

      Its great news waited a long time for this just a shame we don't get all the back pay till after Christmas could of treated my son with extra presents I think it takes six weeks for them to pay your money never mind thou a least we've finally got it after a long fight have a nice Christmas

      Great news, well done.

      It doesn't always take 6 weeks. What you have to bear in mind forst is that DWP have the same chance to appeal the decision as we do. To be able to do this they must first ask the Tribunal for the Statement of reasons (SOR) and they hae 1 month in which to do this. Then they must find an error in law in making that decision. This is very hard to do and mostly they never bother. Payments can be anything from 2-8 weeks but with the last Christmas payments being less than 2 weeks away it's doubtful you'll recieve this money before Christmas. You can celebrate and treat him to something exptra special, after Christmas smile also don't forgot to tell tax credits, because your money will increase. The amount will depend on the level of care he recieves.

      I got my backdated money 2 weeks after I won my tribunal. So fingers crossed. You may get it sooner. XxX

      Fingers Cross end they don't appeal just wondering I don't really understand it properly it says on the letter my son has been granted mobility but doesn't say anything about care does this mean he hasn't been awarded care I phone tribunal they said to phone DLA but am a bit scared to phone them incase they appeal any advise would be grateful

      The letter from the Tribunal will tell you what he was awarded. If it doesn't say the care part and only mobility then that's what he's been awarded, if the care part was awarded then it would say in the letter. What was his award before you went to Tribunal?

      I find it very odd that the Tribunal wouldn't answer your question when you rang them. Usually they're very helpful. Don't be afraid to ring DWP as they've probably been informed about the decision already. It won't stop them asking for the statement of reasons if that's what they plan to do. Like i said it's extremely difficult to fnd that error in law and mostly they don't appeal or TRY to appeal.

      If your son's award is just Mobility and not the care part as well then then same advice applies to you. You'll need to ring or email the Tribunal and ask then for a copy of the statement of reasons. You'll then need to find a legal person, like a lawyer who specialises in this type of thing to see if an error in law has been made in making that decision. If there has then you may be able to take it to the Upper Tier Tribunal, but it's rare that this happens.

    Just to let use no I rang the dla up and they said they haven't received anything g as of yet so I think it will be after Christmas now so I'd just like to say thank you for all your help and advice it's been very helpful to me and if I hear anything in the mean time I will let use no and thank you everyone
