ESA support group implications???????

Hi there I have recently been put into the support group ESA after shoulder surgery

I am trying to get back to normal but still cannot do anything manual. I have a work focused meeting at the job centre on Monday

If they were to offer me.something do I them lose my benefit .I am really worried because I am.a single mother with two young sons . Wanting to work but cannot .Also have had Fibromyalgia for nine years. My PIPS was stopped unfairly due to am incompetent assessor who gave me the wrong descriptor points and has also evidently contradicted herself. Can anyone. Advise me on this ???

    I would suggest you seek a person up skilled in the dept Policies/Procedures and the Govt Legislation in these matters.   

    You should have taken (if you haven't already ???), the assessors decision/s to task.  The assessor has a manager/s, and these managers have managers etc.  

    They all have due responsibilities and ARE Accountable for what the do and don't do under the Law, Under the Legislation and Human Rights Bill...

    NO ONE is to be descriminated against with or without disabilities.  

    The Assessor F'd up, yourself maybe didn't (a possibility only) get yourself across adequately..   IF you have a Savvy Advocate who could and can be your support person and 2nd voice for you, you maybe a lot better off getting your assistance.

    I am going through tough measures myself 'once again'... I have had to ask for help to get the correct information across to 3 doctors, and appeal my case.  If I lose, I will definitely appeal AGAIN at a Higher level, and at which point I will be shouting publically with Banners from roof tops and beyond, for myself and other Fibro and Chronic Pain sufferers in our deprived state.By Deprived I mean, because some other idiots don't want to acknowledge or accept the technical details and ramifications of Fibro/Chronic Pain and Fatigue!   

    As a Psycologist chap once said, don't let them walk over you, 'Get Angry at them'.   Meaning 'respond to your plight, fight for yourself, keep fighting till in every corner and don't let anyone sway you.'   Of course it's easier said than done for a lot of us as we lose our energy, our minds even!!  BUT it doesn't mean we cannot ASK someone with Savvy knowledge or for some who can afford a legal advocate/lawyer fair enough, but most cannot so we seek Free knowledgable council/advocates who can be our voice/our fighting voice...

    I hope you can find that 'special advocate'..   don't dally, just keep searching till you get that someone and ask if they understand your position, can they get to moving through the whitewash of a mountain for and with you.

    Bless you and may you find your strength along the way...  Your boys will be also appreciative if you off load the fight to someone who can work for and with you in these matters.  It will reduce your strain and suffering.  HUGS ... Big hugs..x

    If you need to ask for an extension of time..do so, then get onto searching for a good Advocate.. xo

    Pollmadoll61 you are not alone for 2 years now I have been arguing and disputing a lot of things that the pip assessor had written, luckily for me I had my son with me, my speech isn't too good after a stroke, when my son went to help me with an answer the assessor told him to be quiet, which my son gave her the reasons why he was helping, she took no notice. When my award letter came through she had written, that I had good interaction and very fluent explaining my condition. She bent the truth on many things, she was a DWP soldier, only focuses on their end, I walk with a zimmer and she said that I was able to get about with the zimmer no problem, so don't worry, I think it just depends on whom you get. My welfare advisor is putting a complaint in about this so called assessor as we speak. Please just keep going and hopefully.you shall get someone who knows what medical ailment actually mean, and that you wouldn't be putting yourself through all that stress and anxiety if you didn't have to. As I say I wish these so called medical professionals could live as we do for one day and maybe then, she will do her job properly.

    Many thanks for all your compassionate replies. It seems like we are going up a mountain backwards. I could not believe my eyes when the report said I could lift a part  filled kettle with my left hand but she also clearly stated that my sons prepare the meals due to myy unlimited use of my right arm due to surgery. Does this mean I can use AIDS and appliances to make a meal. Are my sons he AIDS and appliances she states I use?????? I should have got 4points instead of two!!!! When you speak to PIPS they say I have to go to court!!!!!!!!! When ATOS clearly made the mistake

      Go to court, I know it's an anxious procedure, my welfare officer says that's what they want you to do is give up! Get a good welfare officer and fight, they might even change their minds before all this comes out, as it's them that have messed up and believe it or not but the judge is most probably on your side. I know it's hard, but good things are worth fighting for. Atos are a bunch of has been so!!

      It is ATOS...the Insurance company that drives the measures, the procedures and policies of just HOW a DWP assessor behaves, assesses, writes up doc's/reports, to set a person/client up TO FAIL. The ATOS 'Insurance company Business' is a business buddy in a few countries with other/s Insurance Co's and businesses.  GEARED by, APPROVED BY the worlds BUSINESS rountables, 'and each Countries GOVERNMENTS.'...   

      ATOS got Bit BADLY by the Americans and Americans 'Sued' their asses off!  Millions upon Millions of $'s worth.  But just a small dent/jink in the bank balance for them.  However, they continue to REAP and RAPE peoples bank accounts, and their LIVE's without so much as a 'fleeting fart', yet their STINK remains up the nostrils and memories of many, hundreds of thousands, millions of effected folk round the globe.  You know these folk, we are those that make up the statistics.   The Sick, the INJURED, Permanently Injured and Disabled, the Chronically disabled etc etc....  

      ATOS has Governmental policies set up and growing, taking over Medical practices/procedures/hospitals/DHB's (District Health Boards), private Insurance company's, Medical providers eg; physio's, psych services, human resources of all descriptions. ATOS Insurance and subsidary other Insurance companies under the same business models with Stakes and Shares in each and all corners of the Globe, Business's basically now with the Governments 'Blessings', RUN and Control all area's of the HEALTH SECTORS...  'EVERY DAM WHERE'...

      Pharmacuetical companys =  'Business'

      Medical and Research Technology = 'Business'

      Accident & Emergency Health and other Health sectors = 'Business'

      ALL involved with Government TAXATION on every dollar, PLUS the extra DIVIDENDS the Governments make from these Area's 'Every Year'....   IT'S HUGE BUSINESS..  This is all over and above our normal Government Taxation.   Does it all get respent on the Individuals when they need the assistance for Health and Disability AS PER THE LEGISLATION/POLICIES/HUMAN RIGHTS BILLS... NO, no it doesn't...   A HUGE bulk goes into accummulation of FUNDS, business funds.

      BUT, like here in NZ, our ACC, (Atos of course)...  Accident Compensation Corporation.  Deny deny deny, delay delay delay, and continue to Deny, driving folk in to the ground, into poverty, and only those with $'s to burn to fight through a Judical system to gain/win

      what was due to them to start with!!!!   

      OMG... Un (f'ing) believable...

      Our ACC Legislation is a 'SOCIAL CONTRACT', the Public are the main Shareholders, the Stake holders... We the Public OWN IT, we pay the pricks Salaries from our OWN Employment Salaries wages, beneficaries still contribute to the funding, also through the $cost at the Petrol/Desiel pumps, Motor Registrations etc etc...  THE GOVERNMENT ALLOWS THE Dept to be run and operated this way with the ATOS Insurance model at the helm 'AS A BUSINESS'...  

      IN New Zealand of course it goes against the Social Contract that the ACC act as a Business Model to focus on MAKING MONEY AS A BUSINESS.   But of course the Government dictates that 'they do just that, MAKE MONEY'...but don't spend it on the Policy/Legisation it was designed and created for.  The strategy for their BUSINESS MODEL is strictly, Deny the people at any and all cost to them..(the injured, sick and disabled), for as long as possible, as permanently as possible.  ALL the Clients case managers/their managers and upper management will all get bonus's for doing so.  

      That's simply how it works 'everywhere'...  NOW the same Policies and Procedures have been drawn up and reflected in the Social Welfare Departments in Governments Globally..

      AND OF COURSE NOW...what do WE have to FACE,  the (F'g) ... TPPA Deal!  O M G!  

      RANT Over.... sorry for the slight suggestions of the odd expletives here and there, but it helps to show true emotive value to my thoughts and own values on such a subject as ATOS!!!  grrrrrr...
