finally won my appeal

I had my p i p benefits stopped on May the 17th this year and my ESA benefits at the beginning of the year. Even though I currently have no left hip and have many other health issues the ESA benefit awarded me 0 points and I only got 8 in total for the P I P . I decided to appeal this and went to my tribunal two weeks ago I ended up getting 24 points for my ESA and last week I had my pip tribunal and I got both benefits on a standard rate. This just goes to show that if I had not appealed this I would have had nothing, but just from getting my head down and appealing this not letting them beat me I finally got all my benefits back this is just to let you guys out there to have a little bit of faith and know that you have to keep on trying good luck to you all and don't give up...

Well done you Martin and thanks for sharing it with us.
I was on DLA for almost 20 years and then 'invited' to apply for PIP, I'm still waiting for my decision. It is a very stressful situation as you very well know and it's good to hear of success stories - thank you.

Hi Martin
Thats good to hear it gives you hope and shows that you should never give up and keep fighting because it's wrong what they are doing to the disabled now!

Good advice, but you do have to remember that there are a large number of people that are disabled and because of that do not have the ability to fight the DWP all the way to a court hearing.
In my particular case I have had to undergo 16 face to face assessments, 14 of them resulted in having to go as far as an appeal. That together with the last one that went on for over half a day and required me having to read and understand all of the law and previous legal cases in order to defend myself. I just couldn't cope with another round of this so gave up the offer to move from DLA to PIP (HRM & MRC) earlier this year at 68.

That's terrible u had to go so many times..This is why i wrote to my mp and various other people(probably didn't listen to me).when i won my Esa appeal there was a big confusion with me chasing them when my claim would start and some guy made me do a new 40 minute application form and go and get a sick note. After doing all of that they said it was a mistake and my claim was done..I have said to them and my mp if i was a really vulnerable person with no help i would have been stuck at home not knowing what is going in.Not only that something has to change with the pip benefit as they have worded it so cleverly that it is so hard to get it..One day they are going to push the wrong person and something bad might happen like someone giving up and taking their own life.Sounds silly but this is bringing people down...I wrote that post not to brag, i was in bits when they stopped my benefits and like i said they gave me 0 points for my ESA benefit..i was so stressed and thought i would never win these appeals. But i stuck with it got a bit of help from a charity based organisation, and i won..so im just trying to let people know that it might not work but its worth pushing it and trying at least and there is hope for some of us and if not at least u tried, but its still wrong..goodluck

Everyone, tribunal for me was intense, upsetting, but someone really listened to me. Remember everyone Martin is right, but when you receive that letter that you have won your appeal/tribunal - great/ no more/now taken it away, trust me so tired of it all everyone, feel like people really need to know what is going on out there?

I know that it's no consolation, but your experience of the PIP system was everything that I thought it would be.
I didn't transfer from DLA to PIP simply because of what has happened to you would have happened to me and I don't have the strength to fight them anymore.
