Help with pip question

Hi i was awarded 12 points for following a journey on the mobility section by medical assessment but the Dwp marked me down under a different point to 4 points. I suffer with mental health issues was given enhanced daily living for on going award is this normal for dwp to go against the medical assessor any advice would be grateful.

    Hi Daz,

    It's very rare for them to do this but it can and does happen.

    When was the decision made? You have the option of asking for a Mandatory Reconsideration (MR) you have 1 month from the date of the decision to ask for this, although with good reason if it's outside of that timeframe then they will accept the MR request within 13 months.

    You'll need to put your request in writing stating what you disagree with. Be aware that asking for the MR they will look at the whole award again and not just the mobility part. You can lose everything you already have, or it can be increased or stay the same. Only 20% of MR decisons change, so most likely you'll have to take it to Tribunal, if you go down this route.

      Hi thank you for your reply my sister looks after everything for me and she read in news about mental health and looking at cases they have wrongly scored ive been on it for 2years my sister just read the medical report and she thought I might fit into that criteria

      I thought it maybe this you're asking about. DWP will be looking through all files for those who currently claim Mobility part of PIP. If you are one of the ones that will have extra points because of this then DWP will contact you sometime in the future. There's no need to contact them because they have 1,000's of files to look through, it could take many months for it to be sorted.

      You say your award was 2 years ago? If this is correct then the news changes that were announced yesterday won't affect you.

      Mine was awarded 2 years ago approx and I have been sent a review form too

      Daz is unable to appeal his decision because it was made 2 years ago. MR's and Appeals are within 1 month or 13 months if you have good reason why it wasn't requested within the first month.
