I have just been told I have failed back surgery

My surgeon has told me I have failed back surgery I think he has ruined my life and I want to sue him

    Ah-hah!! The fact that the 2nd surgeon admitted to you that hat he had already spoken to the 1st one, and presumably without your prior authority and consent, is a breach of patient confidentiality and you can certainly complain to the G.M.C. about this 2nd doctor on those grounds alone, if you wanted to. Did you have anyone there with you to hear the 2nd doctor admit this or not? If not, is there a train of emails/correspondence which back up your allegation? If none of the above, I'm expecting the 2nd doctor to now completely deny having said this. However, breaching patient confidentiality is supposed to be serious professional misconduct.

      yes i had my wife sittng next to me when he said it one works in one private hospital while the first surgeon works in another private hospital it turns out that they both work for the same trust its a joke i said you spoke to the other surgeon he said i mentioned it

      Is it breaching confidentiality to discuss a patient with a fellow medical professional who is taking over that patient's care??

      I wondered that as well.....I know about breach of confidence but I wouldnt have thought it applied to  doctor to doctor?

      Its annoying.......yes.......I had been going to the eye hospital for 3 yrs and gettig no where!!!!!! I asked my GP to arrange a 2nd opinion

      I got a letter with an appointment ........different doc,different hosp, different authority.........I went, only to discover that he was based in the original hospital and only had a clinc here once a month. He also had my notes in front of himeek

      i know but i am in so mch pain i cant really think of anything else really i went to another sureon after that he told me that he could fix it aswell but would not operate same reason would not go over a colleague work he also said surgeons can refuse to do treatment privately but the NHS cant so thats why i went to them and they told me the truth

      I have heard of surgeons saying that before. i think you're doing the right thing by going through the nhs instead. Most NHS doctors and surgeons do private work so you shouldn't find any difference in standards.

    Oh yes it is. From memory, there was a case where a patient saw someone like a psychiatrist, who then went behind the patient's back and wrote to the GP about the consultation. The patient had not consented to, or even been first told about this. The Claimant  won limited damages in the region of, I think, c.£5-£6K. Obviously, if the specialist had told someone non- medical, and not the GP, then damages would have been even more.

      I think pscychiatry is a different kettle of fish. You are told that what you say is confidential to a psychiatrist. I work in a hospital and i can call up any department and ask for info about a patient. If it is relevent to what i need to do with them then the information will be shared, it would be negligent for it not to be. What if you had a heart problem and i wanted to do something to you that could potentially cause a heart attack?

    The point is that if someone has gone to a back surgeon without going through his G.P., then the results of that private, 'closed' consultation are private and patient confidentiality should not have been breached. And even if the patient got referred from his GP to the private surgeon, another private surgeon, in another non-NHS setting should not have spoken with the 1st surgeon without clearing it with the patient first and therefore without prior patient consent. For the 1st private surgeon to divulge anything in these circumstances is unlawful. Full Stop.

      i toally agree wih you but the first surgeon done the damage that means i have two complaints what a saga and to think i paid for all this mess

      i would like to know whos fault it is that caused failrd back sugery i had never ever heard of it until i was told i had it
