I just lost my pip court case

So I just went though 4 gruelling hours only to have no change on my award I can hardly walk yet still no award for mobility I want to appeal to the upper teir court but don't want to go though that again anyone appealed that could tell me what happens

    Hi Melanie,

    I'm sorry to hear that. To be able to appeal to the Upper Tribunal you must first email the Tribunal and ask them to send you a copy of the statement of reasons. Once you have this you must then find someone who specialises in finding an error in law. In other words the Tribunal must have made an error in law in making that decision. This is extremely rare and a very difficult thing to do.

    If an error in law in found then the whole process could take months and months. Well over a year infact.

    Do you currently have an award? If so how long is your award for?

    You have a couple of others choices. You can either wait for your review and in the meantime gather as much evidence as possible. Or you can put in a change of circumstances and start the process over again.

    Change of circumstances is very risky, i'll be honest. Only 47% of those reporting change of circumstances have a decision in their favour. As you've only just been to a Tribunal and lost then a change of circumstances this soon may not be such a good idea. The decision is yours of course.
