Incorrect repair

I had a laparoscopic HH repair 2 weeks ago and today I had my post-op appointment. When the Dr felt around I wanted to ask how long it would take for the bulge to go away (above my belly button) and he told me it feels as though there's another one above where they "repaired". Either that, or there is fluid there. I have to go back in a couple weeks for another check up to find out for sure if the "fluid" goes away. I'm angry and worried at the same time because it looks and feels the exact same as the area before they did the "repair" which was apparently below the area it should have been. So basically they did nothing in my eyes. He claimed the repair was a hernia that was in my belly button but the one that is visible and is above my belly button. Is this something I can sue for?

    Hello! I want to start off and say I am not a law specialist or a doctor and have never been involved in law. To sue I believe you would have to have proof that they didn’t repair the hernia. For example you can get a unltrascan or a CT scan/MRI and they can see if the prior hernia is repaired (they can see this by where the mesh was placed and the swelling from the healing) and see if the new hernia is in a different spot. Also I believe their might need to be some injury’s depending on the surgery. Also check what documents you signed before the surgery to see what you agreed to.

      Also know that each state has a statute of limitations in which after a certain amount of time you can no longer sue-that’s why in my opinion surgeons always say give it more time to get better and they keep pushing the time table out for healing.

      It is very hard to go after a surgeon unless they operated on the wrong body part or left a instrument inside you. 

      Find out if they used mesh inside you and what type of mesh they used. Of the mesh failed you might want to consider getting it out of you while it’s early on-don’t let them out more mesh inside you. This is plastic and can cause damages and pain immediately or down the line
