Is it an assault?

My friend and I have had an arguement over weather or not it would be assault if someone were to sleep with someone who has herpes and not tell them that they had herpes. I thought that kinda stuff would only be criminalized if it were death related like Aids but with Herpes it doesn't kill you. So is the answer yes it's considered an assault or no?..... If that made any sense at all.😕

    Umm I think lots if people have contacted Aids or HIV and died but ive never heared of them being arrested for assult over it.

    Human rights would have something to say im sure! Lol.

    Criminal transmission is the word .

    I don't think you can get in trouble if you don't alert someone that you have herpes and you have sex .. And if you could I would've been the first one filing a report about it because I never got alerted that the other person had herpes ...

    Unless it's AIDS / HIV I don't think so

      I believe that in some states/places, it is unlawful to lie about one's STD status regardless of whether it's HIV or not, but in most states/places it only applies to HIV. Civil cases can certainly be lodged, and won, regardless. Doubt it's called assault, though!

      P.S. You are correct, btw. With respect to HIV, it is known as criminal transmission, where it is illegal to intentionally or recklessly expose someone to the virus without their knowledge, etc.
