Job termination

I had hip replacement surgery done in October and went back to work 2 weeks later had trouble and had to have hip revision surgery done in March due to the fact it came out 3 times one at work I've been off since April 23rd using my vacation now my vacation is all used and I am still off with a doctor's note and drawing temporary disability does anyone know if my job can terminate me as long as I still am under doctor's care and have a doctor's note to be off spoke with my boss last night and he asked me if I was coming back and I said that was not my choice that would be the Doctor's Choice my leg is still numb and can't drive and can't move I think there is a pinched nerve what or does anyone know anything about whether your job cannot terminate you or not

    Goodness Amy - what a string of bad luck. I am so sorry. I don't have any advice re legal status of your job termination unfortunately. But I am surprised by the decision.however I live in Canada and it may be different here.

    I wish you better luck in your recovery from here on in.

    Are you eligible for FMLA? If so I believe they can't terminate you during the 12 weeks covered by FMLA. After that time I'm not sure but I would hope that they would be sympathetic to what you are going through.

    Are you in the Uk ? If so you should be protected - they would have to send you for Ann occupational health assessment re your fitness to work - if between you and them you can agree on a time you'll be fit to go back along with any reasonable adjustments then you should be ok - depends in part on the size of your company , number of employees etc . If not fit to return to previous job even with reasonable adjustments is there alternative role they can offer you. If you are not fit to return , may not ever be then ultimately they can terminate on grounds of ill health - most companies are pretty supportive and keen to obey the letter of the law and you should have a graduated return after a long time off - hope this helps ? If you are not in UK then I'm not sure if the legislation sorry - big hug xxxx

    Wow, you have really been through a lot! I don't know about the employment question, but am surprised they let you go back to work after two weeks of having a hip replacement. That seems way to soon to me. I hope that things work out and get better for you, and that they find out what is going on. Wishing you well....Barb
