Hiya don't no if you remember me I put up a discushion just before Christmas just to let you no my son won his appeal and I had to wait the 28 days for d w p to appeal on decision now they haven't appealed this but I phoned them yesterday to see w whats happeninew with paymenthe they have told me now my son was awarded high rate mobilty but they didn't say weather here had care so they are holding payment back till they get a discussion about this they hAve wrote back to court to see does anybody no how long I'll have to wait or can they take the mobilty of him if they refuse the care am so confused by all this its nearly 13 months now the man that phoned me from d w p told me I wold have payment for 2 week in January but because they havent given decision on care won't pay the other one out is this right could anyone please advise

    Hi,

    you can be awarded either part, you don't have to be award both parts. Some people only quaify for mobility part because the descriptors for Daily living don't apply to them.

    Some people are waiting 6 weeks or more for back dated money, so 28 days really isn't that long. To find out more info you can ring the Tribunalor email them, rather than write to them. I'm sorry i couldn't help you further. Hopefully you're not waiting oo much longer. I know it's very stressful.

    The only way they can take the mobility part off him is if they take it to the Upper Tribunal, for this to happen they will have to find an error inlaw. As explained in your previous post. Good luck.

      What there saying is they won't pay mobility out untill they find out about the care side as when a I got award it didn't say anything about care side the dla said they had to write to court to see what was awarded for the care side before anything gets paid at all they haven't appealed the dicision just won't pay it till they no

      The Tribunal would have written to DWP straight after a decision was made, so i'm not sure that DWP are talking about. As i said you can call the Tribunal first thing Monday morning to ask them directly as it seems like this is the only way you're going to get the correct answers. Hopefully you'll get those answers and then be paid the money you're owed. Good luck.
