My P.I.P Claim and Decision

I have diabetes, sleep apnea, and Neuropathy.
I am on medication namely Gabapentin, Codiene,
Metaformin I also need to have four injections of nerve block in to the back of my head on average every thirty days, I was awarded standard rate with daily living I was two points off high rate and I was awarded standard rate mobility I was one point off high rate the descriptors used to deny me the point was in my view chosen to avoid awarding me the higher rate in both cases.
I appealed and they withheld there original decision if you have any questions or advice please comment below.

I'm sorry to hear this. Firstly PIP isn't awarded based on a diagnosis, it's how your conditions affect you daily.
When you say appealed do you mean Mandatory Reconsiderstion (MR) or Tribunal? If they withheld the original decision do you mean you lost the award you were given? I'm sorry but you haven't given enough of info for me answer you. I'll gladly help with more info.

Yes of course I'm sorry I'm new to this kind of thing. About 5 years ago I started getting pain in my back wasn't too bad at first then over the course of around 18 months it was so servere I would end up in A&E a lot it started becoming not just back pain but severe headache and feeling of sickness whenever I walked more than a few minutes I.e from car to school gate with children in the morning. After a while it got much worse not I get pain all over my head and body the only way I can describe it is like some one switching a light on and off all over my body with striking pain occurring when they do. My neurologist said it could be diabetic neuropathy peripheral neuropathy hemicranial continua but they treat it with medication and nerve blocks. Yes Sorry my appeal was a M.R (mandatory reconsideration) hope this helps abit more any further information required just ask. Kind Regards

Hi,
You didn't say if you lost the whole award with that MR? Anyway your next step would be to take it to Tribunal. You only have 1 month from the date of decision to do this. Hopefully the decision was recent. You'll need to fill in a SSCS1 form for the Tribunal Appeal and you'll need to send a copy of the MR decision letter with the words Mandatory Reconsideration clearly stated on it. Send any extra evidence you have to support your claim. There's plenty of info on the internet about Tribunals, CAB are also good at helping with these. Advice also to appear in person at the Tribunal because decision are more likely to go in your favour if you turn up rather that ask for a paper based decision. Waiting times for this can be long and totally depends on what area you live. Remember on average 66% of decisions are overturned at Tribunal if you appear.
