Hi I have an ongoing pip claim that is at the stage of going to a tribunal although I don't have a date for this yet. I have complex ptsd, depression and anxiety. My anxiety out of the house alone without someone I know or without my 3 year old is so bad I don't ever go out unless I'm with someone or even answer the front door if I am home alone and someone turns up unexpectedly. Because the element for mental health and mobility was taken out for a while and I have scored low on other parts fairly and some unfairly it has had to go as far as a tribunal I was wondering if my case might be on that will get reviewed now the courts have ruled it was unfair and discriminatory to take the mental health element out of the assessment?.
The whole processes has driven me crazy for months.

The government has just lost a court battle on the mental health aspect of PIP. They have been right so and so's on this area of PIP and have tried to save money in this area by not giving awards.
They have decided not to appeal the decision, and are looking at all the claims again which could take ages and they will now be making payments, back dated for your type of problem.
The court will be very sympathetic towards you and you have nothing to fear by going.
It could be that you get a phone call from the DWP days before you go to court offering you a deal. They did that with me.
