PIP DOWNGRADED

I am looking for advice, I have been downgraded after my recent ATOS assessment for PIP, I was previously getting the higher rate on both my review wasn't due until JULY 2017 however it was reviewed etc and it's been downgraded obviously this new rate starts from 3/10/16 my normal 4 weekly payment was due to be paid on the 5/10/16 which they stopped as clearly there would have been an overpayment by 2 days. To date I still haven't received this payment & I have received a letter stating my new rate & the first payment of this will be on 2/11/16 then every 4 weeks following this....... has anyone else had to wait this long to get there normal payment following a review etc...... and I also need advice on challenging the decision made by ATOS as this is clearly unfair given it's a year too early & my health is clearly worse than when I was awarded PIP at the higher rate. I have no idea how I will be able to continue getting help with my personal care & help with my 6 year old daughter, as my money was helping towards these costs. Thank you in advance for any help & advice

    Pip is paid a month in arears so i would call them .if you ask for a reconsideration they could reassess and stop all your pip .i would speak to CAB

    Dear Emma,

    My daughter heard this morning that her mandatory re something had been turned down and that she would be getting std.living and std mobility.

    She has been in a wheel chair for 12 years and yet the assessment said she could walk, upstairs, in fact live a normal life,she is on morphine 4 times a day.,

    We are going to tribune, I have been researching and am seeing a specialist with my daughter next Weds will let u know how it goes. You must fight, if we all give in then we have lost. Without mobility(she has now lost the chance of her house being adapted) she will be locked in in 4 walls at 49.

      Please keep me updated on your daughters situation, I am shocked by how the health assessors make such descions. My heart goes out to your daughter and anyone else who has been affected by these people. I was so badly affected by how I have been treated that if it were not for my close family & friends helping me out over the last 7 days i had negative thoughts to the point of not wanting to be here anymore this is so selfish of me given how precious life is & I hate myself for these thoughts but I just couldn't see a way forward, I Sm taking it day by day but my struggle seems endless, please stay in touch & goodluck

      atos assessment in london much better than outside london they have very good experience .

      Morphine or any similar drug is not taken into account. I take up to 100mg of 12 hour lasting (MST) twice a day + as much Oramorph as I need.

      ?I wasn't allowed Attendance Allowance for my care.

    All time dated awards are extended by the decision maker. If it was a 2 year award they would make it a 3 year one. The extra 1 year gives the DWP time to re-assess you.

    ?I presume that the PIP was for you so I don't understand why the reduction should affect your daughter?

    ?As you say, the PIP money is there to help towards the extra costs that the disabled person has - it is not extra money for the household to live off.

      I never said the money was for my household to live off, the reason it's affecting my daughter is as I now haven't had my last PIP payment I have used my daughters child benefit & tax credit payment money for my personal care which enables me to lead a normal life when I refer to my personal care I have someone who supplies me with my lady nappies & other care items to bowel & bladder functions as you can imagine this would be everso slighty embarrassing for me & my family should I not get the daily care I need

      ?which made me wonder whether it was your PIP or if it was for your daughter. As it is not your daughter I fail to see how your PIP is affecting her. You say you are using money that you receive for her welfare & upbringing on yourself?

      ?In the world that I and most people live in, if someone has to do without or make choices over how you spend your money it should be the parent and not the child. 

      ?When our children were growing up every penny from Family Allowance went on them even to the extent that we had to go without.

      Please re-phrase - you might win - you have about a 55/45 chance of winning at a Tribunal.

    Sorry to hear this emma. I have higher mobility and low care. I my award runs out next year but I'm being reassed now. I have been informed that are coming to my home. I'm a nervous wreck with it all
