Hi wonder if anybody can give me some advice I've got tribunal coming up I got 10 points for care 10 for mobility at assessment theory took me mobility car off me a couple descriptions I thought I should score more both on care and mobility I suffer emphesemas osterarthrities osterpoais reutisiam ortherities I wary that they could take points off me any advice I would be so grateful for Jean

    Hi Jean,

    A Tribunal can NOT lower an award without first warning a claimant. They would warn you by writing you a letter stating that they were planning on lowering your award and give you the opportunity to cancel the Tribunal and take the award you already have.

    Are you claiming mobility part for physical or mental health? Have you sent more evidence to the Tribunal to prove that those descriptors apply to you? If you haven't and you have more you must make sure that this arrives at the Tribunal at least 1 week before the hearing. This will then give them time to read through that evidence before the hearing. If you take it with you on the day the chances are they won't read it because they will not have time.

    During the hearing they will ask you questions about your condition and how it affects you daily. Answer with as much detail as possible. They will listen to everything you have to say. 65% of those who appear in person have a decision in their favour.

    Sometimes they can't make a decision on the day, if this happens they will write to you within a couple of days with that decision. Good luck.

      Sorry for interrupting your thread Jean but I just wanted to tell Denise that when I reported of a change in my condition in November last year I rang yesterday and I got a 5 year award this time for higher rate mobility my care remained standard but I’m so happy with the decision thank you for your advice xx Jean good luck with your tribunal xx

      Fantastic news Deborah! So glad i was here to advice you. It always makes me so happy when i hear good news. The Enhanced mobility will now allow you to have a mobility car in exchange for the weekly mobility payment. All you need to pay for is fuel, everything else is included. If you don't choose that car and you have your own car then you'll get 100% free road tax. If you did take the road tax then the car can only be used for your purposes. xx

      Thank you very much Denise I just wanted to share my good news to show that I had a good and fair report from my assessor and  it’s not all doom and gloom take care Denise I’m sure your a great support and help to a lot of people xxx

      Your feedback from your assessment report will be a help to a lot of people i'm sure. We very rarely hear about the good reports, only ever the bad. I've never had a bad report either. Lets hope there's many more like us. Relax now and take care xx

    Hi Jean. I went to tribunal last June. I was awarded enhanced rate care and mobility for 10 years. I forwarded all new evidence to the courts before the hearing. As a lady my mum spoke to said we could forward these and they would be used as evidence at the hearing. I took advice from Denise as well as my mum who was my representative. Just answer all questions honestly explaining how your condition effects your daily living etc.

      Hi mark how many points did u get before going to tribunal  really don't know what to do I was on high for mob and care for 5 years so lost my mobility  Car grateful for any advice jean

      Hi Jean,

      Please don't worry, as i said a Tribunal can not lower your award without first warning you before your hearing. They must send you a letter stating they are planning on lowering your award to give you chance to cancel the whole thing. If you were transfering from DLA when you lost your mobility car then please do remember that the criteria for mobility PIP is different. Are you claiming for mental health or physical disabilities?

      Hi Jean. 10 for daily living. They took mobility away. But as i said got enhanced for both at tribunal. Please don't worry. They cannot lower whst you've already been awarded at tribunal. Good luck.
