Pips tribunal couldn't make a disscion

Hi,

I applied for pips last year and was turned down by DWP.

It went to tribunal but I don't go out on my own and suffer with terrible depression and anxiety also with night terrors. But the court is now saying they want me to attend to make their disscion. But I really don't think I could handle this.

They also want my medical records?? I don't know why? My doctor thinks I wouldn't be able to attend either and said he would write me a letter?

Could anyone advise me please or been in the same situation

    Hi Carly

    As already stated you should get a supporting letter from your GP.

    However, I'm not sure that Tribunal's do home visits but you could give permission for access to your medical records and request a paper only review of your case.

    Otherwise the only other option is to attend the Tribunal with a supportive friend or welfare specialist from the Citizen's Advice or Welfare Rights.

    You have to show willing to co-operate or the Tribunal will simply reject your application.

    Hi carly171.                                                                                                                                    Did you have an an assessment before being refused PIP? Or were you refused just on the form you sent in?  Ta.

    Hi carly171.                                                                                                                                     You haven"t mentioned anything about having an assessment. Were you offered one, or just refused on the value of the SSC1 form you compleated? Ta.

      Sorry for the late reply.

      They wouldn't give me a home visit as they said they wouldn't feel safe with my Mentel health situation

    I won my case by a paper consideration with the Tribunal people but it did take nearly ten weeks to get a decision

      Hi pollmadoll64.                                                                                                                Glad of your"e outcome. Did you go through the ordeel of an assessment first? Not sure if carly171 has. This could be why the Tribunal people don"t know anything about the claimant, such as, med reports, history and medication, (if any). At least even a sham assessment (as is the practice) would have had to produce this info in their report. Anyway, that"s my view of it. Ta.

      The irony is I did go through an assessment back last May and was awarded 16 points before surgery then when I really needed it I had a sham assessment  in Jan with PIPS and had it taken from me. So I then had to fight for it back through the Tribunal after my Mandatory Reconsideration was refused. ESA put me in the support group without an assessment the same time PIPs took it away. ESA took my money away two days after surgery going by a sham assesment back in August. So I have had to fight both ESA and PIPS and won both times!!!! I am now considering working for CAB to help other people fight the system. That was after I saw my local job coach today who works for the DWP !!!!!
