Question about Disability Benefit
Posted , 17 users are following.
I'm in he process of waiting for a appeal to go to a independant tribunal for Disability Benefit. I've been diagnosed as having severe Cervical Spondylosis - I also have a Myclonic condition [muscle spasms] I'm in pain 24 hours a day - and find it hard to cope with life - The decision makers at the DWP turned me down for Disability Benefit on the grounds that I'm able to walk in their opinion 200 metres before the onset of severe pain.
The question that I would like to ask sufferers of CS is:
Are there any fellow sufferer of Cervical Spondylosis out there that have been [granted] Disability Mobility Allowance?
Reason for the question is: I believe that the DWP dont class this condition as being a disability - Please respond it's very important.

I've paid the £25. because as you know I've just come out of a big battle with the DWP and really would like some peace and quite, for a few months anyway.
But I've put a letter into them which outlines what they had wrong in their car park:
Firstly they had no indication on entry that blue badge holders had to pay for a ticket ( they've since changed this and have placed big signs outside.
Secondly: They provided 10 disabled bays - none of them had any signs on them saying that blue badge holders had to buy a ticket.
Thirdly: The car park housed TESCO- POUNDSTRECHER-ARGOS
most of these huge companies have a policy of providing disabled bays - free of charge, and have recently been made to allow blue badge holders unlimited time.
I told this parking company that I had no reason to look on their notice board, and in fact, if I had, it wasn't cleary defined that blue badge holders had to pay for a ticket. The message was amoungst other text with no symbol of the blue badge present.
Fourthly: There's a law in this country that says that it could be classed as \"indirect Discrimination\" This means \"when someone puts in place rules that apply to everyone but put you at a unfair disadvantage because of your protected characteristic.\" I told them that it was unfair to expect people who have a mobility problem to walk over to a notice board and read their rules.
I 've also told them that they should get in line with other private car parks and give blue badge holders free parking. And that I expect them to return my cheque.
I'll let you know what happens next - if anything?
Well done Juliem - I wouldn't worry too much about the review for DLA Once they have awarded it to you - it's very difficult for them to take it back - the onus is on them to prove that you're no longer entitled to it, and they have to back this up with medical evidence. Good luck to your hubby, and well done for keeping on to them. This is what these pages are all about.

Yes I have c s along with other things it's not the condition you get pip
For its the effects off the condition if you can walk 200 metres you won't qualify for mobility unless you are very slow how long does it take you
Are you able to walk the 200 mt back to where you started , and can you repeat later in the day .
I would recommend you get in touch with the welfare rights team at your local council they will advise and organise your appeal if that's what
You want to do they were a massive help to me
Take care
