Who can access / has permission to access Doctors records PMR under ANY CIRCUMSTANCES?

Hi, unfortunately i cant see a category thus question fits into on the site. I'm looking for a concrete defiinitive answer or link to information on this plse. I raised a concern at my mothers care home regarding her personal treatment and substandard care. The issue did not not directly involve other residents. I remived her from the home. A safeguarding enquiry was initiated which in my opinion was non transparent and lacked thoroughness. I have since found out that the manager of the home telephoned my mother surgery and asked intimate questions about her medical history and creams prescribed and asked for an email to be sent to her regarding it! Also the safeguarding employee spoke to the Dr regarding a private telephone consultation I had with my mothers Dr. My question is, who is allowed to access confidential records and if the information is deemed to be of importance to an enquiry, should my mother or me as LPA not have been notified or asked? At no time has this ever been done and it is only because we requested a SAR of my mothers Drs records, that we have uncovered this quite astonishing revelation. Thank you for helping me.

    Is your Mother able to give consent for her medical records to be accessed? If so, she should have been asked to sign a consent form to this effect. If not able then you should have been asked for your consent. Perhaps whoever gave out the information thought your Mother was still in the home and that is their error. If the access was required for a safeguarding enquiry the it should have been via a solicitor and not the Care Home manager. The solicitor would have known that permission was required first. Even though you have LPR if your Mother is able to reason then her permission would be required first
